The legal basis for a C4 Motion to Dismiss is under Rule 3.190 (c)(4) of the Florida Rules of Criminal Procedure. Under this rule, the court trying the case may entertain a C4 Motion to Dismiss anytime if it alleges that no material facts are being disputed. It should also raise the issue that the undisputed facts based on what both sides have raised aren’t enough to continue the trial against the accused.

However, the government agents may file a traverse that disputes or denies some or all of the material facts raised in the motion to dismiss. When this happens, it’s not unlikely that the C4 motion to dismiss would be denied. 

3. Motion To Dismiss Based On Statute Of Limitations

Another ground to have the charges against an accused or defendant dropped is the motion to dismiss based on the statute of limitations. The basic idea of the statute of limitations is that there’s a deadline for the prosecution or plaintiff to file the charges against the accused or defendant. In other words, they have to file the charges before a certain date arrives.

This is usually counted from the time that the crime was committed. However, in civil cases, this is counted from the time when events happened that would give rise to the cause of action. The accused or defendant may file a motion to dismiss alleging that the statute of limitations has passed when the prosecution or plaintiff fails to file the appropriate charges before the deadline lapses.  

The statute of limitations can range from one to 10 years depending on the nature and graveness of the crime. But some crimes aren’t covered by the statute of limitations, such as:

  • Felonies that are classified as capital or death penalty
  • Felony crimes when a person died as a result

  • When the accused lied under oath in a case involving a capital felony

Gaston Police Find 2 Lb of Pure Fentanyl in Car – Enough To Kill Everyone in Gaston County Twice

The Gaston County Police Department and Drug Enforcement Administration (DEA) just announced a major drug trafficking arrest off North New Hope Road near I-85 in Gastonia.

Authorities found over 2 pounds of pure fentanyl (synthetic opioid) during a traffic stop in a vehicle being driven by 2 men from Tennessee. The stop was a part of an ongoing DEA investigation into Fentanyl trafficking into Gaston County.

According to the DEA, just 2 milligrams of fentanyl is enough to be lethal (depending on a person’s body size and tolerance). There are 453,592 milligrams in a pound and the Gaston County population as of 2019 was 224,529, so the amount of fentanyl discovered in the vehicle would be enough to kill everyone in the county twice over.

North Carolina recently changed several laws related to opioid overdoses to help curb the epidemic, including changing Naloxone (opioid overdose suppressant) from prescription to ‘over the counter’, as well as implementing a new ‘Good Samaritan Law’.

The law essentially protects people who administer Naloxone to someone who has overdosed from any liability.

Anonymous $10 Million Gift Will Fund New Tailgate Park At Charlotte

A sudden $10 million anonymous gift will now fund the construction of a three-acre ‘tailgate park’ complex at Charlotte (formerly known as ‘UNC Charlotte’) to provide year-round opportunities for informal and organized student gatherings.. The Tailgate Park is scheduled to open in time for the fall 2022 football season.

“We are grateful for this generous donor’s investment in Charlotte that will help build robust collegiate experiences to balance life in and outside the classroom; in particular, this Student Outdoor Event Venue and Tailgate Park will transform students’ overall experience on campus in novel ways,” said Chancellor Sharon L. Gaber. “As the Charlotte 49ers prepare to join the American Athletic Conference, this facility will help us sustain momentum for becoming a nationally recognized institution.” 

Student Outdoor Venue and Tailgate Park_1.jpgThe Charlotte Foundation will oversee construction of the 8,000-square-foot entertainment pavilion that will anchor the complex and whose student-focused design will be a distinguishing feature in higher education. It will be located close to Richardson Stadium near the North Carolina Motorsports Lab and football practice fields, and include power pedestals to support individual tailgating areas. A signature gateway portal will welcome venue users to the complex that will accommodate more than 2,500 students. Mature landscaping will be planted to reinforce the venue’s park-like atmosphere.

“We want all of our fans to have positive, memorable experiences at our games, and that is especially true for our students,” said Mike Hill, Charlotte’s athletics director. “This new facility will give them new ways to engage on our campus and with our athletic program. We are excited about what this means for Charlotte football in the fall.”
