In the United Arab Emirates (U.A.E.), Copyright is protected via international agreements, Federal Law No. 7 of 2002 (concerning Copyrights and Neighboring Rights (“Copyright law”), and other laws relating to copyright enforcement or regulating copyright protection. The copyright legislation was passed on July 1, 2002, and it was published in the official gazette (No. 7) on July 14, 2002, and it came into force on that day. Further, Federal Law No. 7 of 2002 repealed all prior laws that conflicted with its requirements, including Federal Law No. 40 of 1992 on Copyright.

  1. Intellectual Property Law DIFC Law No. 4 of 2019
  • This Law is applicable within the jurisdiction of the Dubai International Financial Centre (DIFC).
  •  Anyone who possesses or claims ownership of, uses or attempts to exploit, or tries to enforce or secure an intellectual property right, in whole or in part, in the DIFC is subject to this Law. 

MEANING OF COPYRIGHT

Copyright is considered to be one of the kinds of Intellectual Property. Copyright refers to the right granted by the Law to the author of any literary, dramatic, musical, or creative work and the producers of cinematograph films and sound recordings. In addition, copyright owners have certain exclusive rights that allow them to utilize their work without interference and prevent it from being misused. Copyright entails several rights, including reproduction, public communication, adaptation, and translation of the work.

WORKS PROTECTED BY COPYRIGHT 

As per Article 2 of Federal Law No. 7 of 2002 of Regarding Copyright & Related Rights, the following works include Copyright and are the subject matter of Copyright:

  1. Work of literature such as books, articles, the innovative title of work, and innovative broadcast program in writing.
  2. Computer software, Computer applications, databases and similar works.
  3. Lectures, speeches, sermons and other works of similar nature
  4. Plays, musicals and pantomimes 
  5. Musicals accompanied with and without dialogues 
  6. Audio and video work or audiovisual work 
  7. Architectural work and architectural plans and drawings
  8. Artistic work including involving drawing, painting, sculpturing, etching, lithography, screen printing and similar works of fine art.
  9. Photographic work and the like.
  10. An innovative expression of ideas, work methods, mathematical concepts and likewise.
  11. Charts, maps, plans, 3-D modelling for geographical and topographical applications and architectural designs etc.
  12. Sound recording.

WORKS NOT PROTECTED BY COPYRIGHT INFRINGEMENT

According to Article 3 of the Copyright Law, the following works are not the subject matter of copyright protection:

  1. Ideas, procedures, work methods, mathematical concepts, abstract principles and facts.
  2. Legal documents including statutes, rules, rulings, international conventions, court judgments, arbitral awards, and judgments of administrative bodies with judicial authority.
  3. News and reports that covers incidents and information regarding any current events.
  4. Works fall into the public domain.

Provided that, if the works mentioned above are arranged and assembled uniquely, they shall be eligible for copyright protection.

 ACTS AMOUNTS TO COPYRIGHT INFRINGEMENT 

Copyright Infringement shall occur when someone other than the copyright owner or someone authorized by him does an act that is the owner’s exclusive right – e.g. reproduction, translation, adaptation, and public performance. Whosoever does any of the following acts shall be liable for copyright infringement:

  1. Violation of provisions of Copyright Law and rights of Authors

Violates legislation requirements to protect intellectual property rights and associated regulations, namely any moral or economic copyright or similar right.

2. Online publication of protected copyright work without consent

Publish a copyrighted work accessible to the public through computer networks, the Internet, information networks, communication networks, or any other means without the author’s prior written permission.

3. To sell, rent or circulate copyrighted work without the consent. 

Without the prior written permission of the author or the owner of the relevant right, selling, renting or circulating, in any form, a copyrighted work.

4. To reproduce or import for sale or circulating pirated copies of copyrighted work.

Unlawfully reproducing or importing for sale, rental, or circulating any pirated copies.

5. Install any computer software without the consent of the owner 

Installs or keeps a copy of computer software, a programmer, or a database on a computer without obtaining a license from the author, the copyright holder, or their successors.

In the case of Hager v. E.C.W. Press Ltd (1998) 85 C.P.R. (3d) 289 (Canada: Federal Court, Trial Division),the plaintiff “Hager” authored a book named Honour Song: A Tribute. This book covers the successes of Canadian indigenous people. One of the chapters of the book contains information about the famous singer Shania Twain. The information provided by the plaintiff in the chapter was based on background study and conversation held with the singer.  Later on, the defendant wrote a book and copied a significant portion of the plaintiff’s work without his consent. The Canadian federal Court determined that the defendants’ use of the plaintiff’s work constituted copying a substantial amount of that work and liable for Copyright infringement.

REMEDIES AVAILABLE TO COPYRIGHT OWNER

  1. Civil Remedies (Article 34 of the Copyright Law): 

The Court of First Instance may require the following measures to be done concerning a published work or exhibited without the author’s or his successors’ written permission:

  1. Put a restriction on publishing, displaying or producing work.
  2. Pass order of attachment of the original work or copies thereof (books, photos, drawings, shows, photographs, sound recordings, materials for broadcast, etc.)
  3. The Court shall also make an order for the attachment, if intended to republish the work, of material utilized in the republication or reproduction of the work.

Criminal Remedies (Article 37-39): 

  1. Any person guilty of any of the acts of copyright infringement (as mentioned above) shall be punished with imprisonment for a minimum term of two months and/or a fine varying from 10,000 to 50,000 Dirham. Nevertheless, the sanction can be higher in specific cases of infringement.
  2. The Court may pass an order of Seizure of the original and pirated copies. 
  3. The Court may pass an order for the Seizure and destruction of infringing goods, as well as the equipment and devices used to perpetrate the infringement.

The Role of Real Estate Professionals 

Due to the nature of the business and activities in the Real Estate Sector in the UAE, real estate agents/ brokers or other professionals are individuals who deal with the sale, purchase, or leasing of real estate on behalf of customers. They may be authorized to perform various functions like representing one or more parties to a transaction, act as intermediaries between parties in terms of negotiation and execution of an agreement or contract. They may also operate in a fiduciary capacity or as trustees, administrators, and so forth.

Real estate companies, brokers or agents, and other professionals who engage in the sale and purchase of real estate on behalf of customers are required under the Anti- Money Laundering Laws to fulfill certain obligations to have effective compliance to the UAE law include 

  • Identification and Mitigation of risk
  • Customer Due Diligence (CDD)
  • Reporting Suspicious Transaction
  • Appointment of a compliance officer 

DUTY OF REAL ESTATE PROFESSIONALS TO IDENTIFY AND MITIGATE RISKS UNDER THE UAE ANTI-MONEY LAUNDERING LAW

Identification and Mitigation of risk is one of the effective risk-based Anti- Money laundering programs in the UAE; thus, it is the baseline of a practical approach to combating money laundering activities in the Real Estate Sector. 

Identification of risk

According to UAE Anti-Money Laundering Law a Real Estate Company/ professional is required to understand, identify and assess its crime risk. In carrying out this duty, a real estate professional is required to identify specific risk factors as

  • Client Risk; A Real Estate Professional is required to know the client’s status if a legal entity or not, the client or customer’s country of origin, the channel through which the customer got introduced to the professional, and all other important information about the client or customer.
  • Country Risk; it is crucial to know the country from which the transactions will be carried out from to ensure it does not fall under the High-Risk Country
  • Transactional risks; A real estate professional is required to know the purpose of the real estate transaction, for example, whether for residential or commercial, personal use, or reinvestment. They are to consider the circumstances surrounding each transaction, for instance, if the customer is in a hurry to conclude the transaction or when the client is involved in too many transactions within a short period.
  • Geographical risks; Real Estate Professionals must consider geographic money laundering risk from domestic and cross-border sources. The location where the customers reside or conduct their activities is significant, and they should check whether the countries or jurisdictions they deal with are the subjects of international sanctions, such as targeted financial sanctions (TFS) 

under the UAE Anti Money Laundering Law, Real Estate Professionals are required to document this assessment and continue to update them from time to time, and to readily make them available when the supervisory authorities request for them.

Mitigation of Identified Risk

Upon identifying and assessing the risk as mentioned above, the Real estate professionals are required to take steps to mitigate those risks. 

As measures to mitigate risks under the UAE Anti Money Laundering legislation, real estate companies and professionals are required to do the following;

  • Develop internal policies, control, and procedures; these internal policies must be in line with the nature and size of their business. Once the policies, procedures, and controls are formulated and put in place, they must be applied to all the businesses carried out by the company. Real Estate Professionals are at liberty under the law to utilize various methods that they consider appropriate, helpful, and suitable in line with their businesses. They must also document the procedures they adopt and apply them continuously to their businesses to have an effective compliance program against money laundering activities.  

As part of their policies, it is crucial to put in place a process for screening customers and intending customers against sanction list. The senior management of the company must approve all the internal policies and procedures before using them.

Duty to have Customer Due Diligence measures under the UAE Anti Money Laundering Law 

Under the UAE Anti Money Laundering Law, Real Estate Professionals must have effective Customer Due Diligence measures (CDD)- they are required to obtain information about any customer before transacting with the customer. Information relating to identity, purpose, reason for the transaction, the source of funds, former business activities of the customer, and countries to which the customer has affiliates and required to be obtained by the Real Estate professionals. 

They are also required to establish and verify the identity of beneficial owners where third-party intermediaries, proxies, or legal structures or arrangements stand for the beneficiary owner and confirm their source of funds through reliable, independent sources. 

In other words, they are required to know their customer by performing background checks before establishing any relationship. The management of the company must also approve transactions of any business relationship with the customer.

Duty to Report Suspicious Transaction.

Under the UAE Anti Money Laundering Law, if Real Estate Professionals have any reasonable ground to believe that the funds for the transactions are a proceed of money laundering and terrorism financing crime, they are mandated to immediately report such transactions as suspicious transactions to the Federal Intelligent Unit through an integrated system called the goAML. Duty to Appoint a Compliance Officer

Under the UAE Anti -Money Laundering Law, Real Estate professionals are required to appoint a compliance officer. The compliance officer is expected to possess the requisite expertise to discharge the duties as spelled out by the law. 

Real Estate Professionals under the UAE Anti-Money Laundering Law are further required to comply with the directives of the Competent Authorities of the State in relation to the United Nations Security Council resolutions on sanction list under Chapter VII of the Charter of the United Nations. They are required to register in the automatic reporting system for sanctions lists to obtain automatically and instantly updated lists of targeted financial sanctions from the United Nations Security Council consolidated sanctions lists and domestic terrorism lists.

From the above, the UAE, in its robust compliance program on anti-money laundering in the country, recognizes the Real Estate Sector as one of the most significant economic drivers. NC Just Felt Another Aftershock From Last August’s Historic Earthquake

This morning at 12:34 am, a 1.6 magnitude earthquake shook Northern North Carolina about a couple miles south of Sparta.

The quake is being considered yet another aftershock from the largest North Carolina earthquake in over 100 years, which has continued to rattle the same region since it first struck last August.

The USGS’s ‘Did You Feel It’ map showed that people reported feeling the quake as far away as Alabama and Pennsylvania:

Because August 9th’s quake was so large, it’s aftershocks will likely continue for some time, and could even trigger other quakes around our state.

According to the USGA, “Aftershocks can continue over a period of weeks, months, or years. In general, the larger the mainshock, the larger and more numerous the aftershocks, and the longer they will continue.”

Earthquakes have been increasing in frequency around the Charlotte region over the past few years. Last year, we saw a 4.4 magnitude quake hit Decatur, TN, and a couple of months ago, a 2.6 magnitude quake rocked a small town just north of Charlotte.
