Fort Mill’s Anne Springs Close Greenway (ASCG) just broke ground on the Greenway’s newest amenity, the 18-acre Crandall Bowles Children’s Farm. Named in honor of Anne Springs Close’s daughter and former CEO of Springs Industries, Crandall Close Bowles, the new children’s farm was envisioned by Anne and Crandall. Anne wanted to name it in honor of her eldest child, who has spearheaded the expansion of the farm to make their dream a reality.

ASCG’s new children’s farm will include pastoral habitat and observation areas for ducks and farm birds, rabbits, alpacas, horses and other barn animals. In states following the negligence per se doctrine, plaintiffs typically must establish the defendant violated a law or regulation. Then, the plaintiff shows that they were part of the class that was meant to be protected by that law or regulation and that they were injured due to the violation. 

As an example, if a defendant is convicted of a DUI, it’s a crime. Evidence of the conviction might be court-admissible, which can make it easier to apply negligence per se. 

For negligence per se to apply, it can only be in a situation where the broken regulation or statute is meant to protect the class of people the plaintiff belongs to. 

If someone is texting and they run a stop sign, hitting a pedestrian. As a pedestrian, you are part of a protected class of people. The traffic laws are put into place to protect you. The driver who was texting and running a stop sign is also breaking state traffic laws. Then, the duty of care breach is inferred based on the conduct of the driver. 

The plaintiff in this situation would only need to show the actions of the defendant directly caused their injuries. 

There are states with variations on negligence per se too.
