Section 1031 exchange investments: How does it work?

0

Tax deferrals are one of the most effective tools in asset management. By postponing the payment of your tax, you allow your investment to generate more income. Your portfolio longevity also extends as tax-advantaged assets are usually availed in higher amounts, and higher amounts result in higher gains that exceed your estimated income and investment years.

To be specific for real estate investing, there exists an IRS code which is the 1031 Like-kind exchanges. In the event where you want to exit a holding and exchanging property, it is most definitely possible for capital appreciation. As the demand for land, structures, spaces, and other real properties grows through time, when you replace your asset, it will be of higher value from the original purchase price. The difference between the price of the asset back then and its appreciated value now becomes your capital gain. However, when you do not avail of the 1031 exchange investment, your earnings from the transaction will be immediately deducted of its tax implications. Whereas when you utilize 1031 exchange investments, you are deferring taxes for capital gains and depreciation recapture. Here’s how it works:

1031 exchange investments allow you to find a like-kind replacement property that is similar in nature and in value to what you have just sold. Your gains from the transaction of exchange will be considered as capital to your new like-kind exchange investment, so it is not truly deemed as a gain at the moment. In 1031 exchange, it is truly a cycle of passing earnings from one investment to the other, and in each investment, your proceeds increase every time which becomes a driver for income generation.

Although the definition and purpose of section 1031 exchange investments are straightforward and can be easily grasped, applying, and qualifying for it is what people will find as a challenge.

What are the guidelines in qualifying for a 1031 tax deferral?

  • Properties being exchanged must be used for investment, rental, and commercial purposes
  • Only like-kind exchanges are accepted in the application for 1031
  • Instead of selling, investors must be exchanging the properties

What are the steps in applying for a 1031 exchange investment?

  • Within 45 days, you must identify a potential replacement property.

You can present up to three properties. If you wish to identify more, there is a 200% rule where the aggregate value of the properties you have chosen should not exceed 200% of the original property. Additionally, a 95% rule governs the case where you can identify multiple properties given that the total fair market value of these properties is equivalent to 95% and are already exchanged by the end of the given period.

  • Hire a reputable and qualified intermediary to handle the legal and financial requirements of 1031. Your broker or lawyer must be truly trust-worthy as the money from the exchange can only be held by an intermediary
  • Close the transaction by exchanging your relinquished property.
  • Make sure to acquire the approved replacement property within the 180-day period.

Gambling in North Carolina: What’s the Current State of Play?

0

It’s widely known that the gambling laws in North Carolina are perhaps the strictest out of all the United States. And right now, if you fancy a flutter on the roulette wheel or a game of blackjack then you’ll need to head off to the only permitted casino which sits on Cherokee territory.

Anything else that’s left behind is a small lottery for charitable causes and a few bingo games. Nobody is being too optimistic about these laws changing either, North Carolina has a zero-tolerance policy on any kind of liberation when it comes to gambling.

To truly understand this strict approach, when compared to other parts of the USA, we first need to look at the history of the State.

History

North Carolina compiled its own constitution back in the 1700’s and has ever since ensured the constant crackdown toward gambling. But back then this was no easy task, and original gambling laws made sure that it was illegal to recover gambling debts. This didn’t have the desired effect, so laws were implemented regarding taxation mostly on card playing and table games.

When this still didn’t get the current gambling situation under control, the State simply banned all forms of gambling in 1764.

Many believe that it’s the position of North Carolina, within the ‘Bible Belt’ of the USA which bears the most influence on gambling laws. And of course, the religious faiths in the State do not go hand in hand with gambling, as people lean more towards a moral and conservative existence.

In the ’70s, discussions arose to permit horse racing and pari-mutuel betting. There were even mutterings of a state lottery which could be allowed to raise vital funds for local charities. These discussions did not go away, and it was pressed that the State allow a casino to be built on Tribal lands, just like other States were allowing to happen at the time. Further pressure was put on the Constitution with regards to the lottery, though it took until 2006 for this to finally be permitted.

There are penalties to be had if anyone is found breaking the current gambling laws:

In 2020, the North Carolina Department of Public Safety states:

‘It is illegal for any person or organization to operate a game of chance or to play or bet on any game of chance that involves winning money, property, or anything of value. Violators shall be guilty of a Class 2 misdemeanor. GS 14-292’

Land-based Casinos

The only casino in which people can legally gamble is Harrah’s, which is situated on Cherokee Native Indian lands. This achieved state approval to open in 1997 where a limited number of games could be played. And it wasn’t until 2012 that the casino was permitted to offer table games, with live dealer games still being illegal even now.

This casino operates under very strict guidelines though, and cannot be considered as an all-out gambling experience like players could have in Las Vegas for example.

In March 2020, despite huge opposition, the go-ahead was given for a second casino to be built. And this will be situated in Kings Mountain, Charlotte. The casino will be a huge operation, and it’s estimated that costs will head into $200 million, with a proposed 3,000 new jobs being created.

The casino is owned and operated by the Catawba Indian Nation, with its location being close to tribal lands that have been occupied by the Catawba since ancient times.

Online Casinos

This is a bit of a grey area and just like in other States, many assume that the existing laws of gambling cover online casinos. There isn’t anything in the current laws that forbid internet-based games. And many people in the USA do currently gamble online at a huge range of international casinos. Enjoying thousands of slot games, video poker, live casino games, and even sports betting at a variety of events around the world.

But with such a massive number of casinos and games to choose from, how do players know which ones are best? It can be a bit of a minefield out there, luckily though there is one such site – Labslots.com – that provides impartial reviews on all things related to online casinos. Helping players narrow down either a site or game that best suits their needs.

These international casinos are licensed in various countries with many currently obtaining USA licenses, to open the market in various further states – offering localized gambling.

What does the future hold?

The Cherokee casino has so far contributed $90 million towards the State of North Carolina in the last 30 years alone. Whilst the charitable lottery provides 5% towards the educational budget, each year. On a global scale, the gambling market is currently worth $60 billion, which is not to be balked at. Especially with regards to online gambling, with certain States offering remote gambling licenses to these operators at huge prices.

There are serious monies to be made in the future of gambling, which other states are starting to realize. Perhaps North Carolina will follow suit?

via Facebook

Apparo, a Charlotte nonprofit aimed at helping other local nonprofit organizations leverage technology, is now accepting submissions for two technology awards: the TechExec Community Impact Award and the Mission Possible: The Economic Opportunity Award.

The TechExec Community Impact Award celebrates Charlotte technology leaders with a proven track record of donating their time, talents, and financial support to nonprofits in need. Apparo honors the award winner at their fall Community Impact Breakfast, awarding them $5,000 of pro bono support to gift to a nonprofit of their choice. 2019’s TechExec Award winner was Courtney Ramey, Market Executive Director at Jabian Consulting. For more information about the TechExec award, please visit https://www.apparo.org/impact/techexec-community-impact-award/.

“The TechExec Award is an opportunity for Apparo to celebrate a technology professional who is using their expertise and influence for good,” Kim Lanphear, Apparo’s Chief Executive Officer, says. “Although IT professionals are usually behind the scenes, this award puts them in the spotlight and acknowledges them for their efforts.”

Apparo’s Mission Possible: The Economic Opportunity Award, in partnership with Accenture, focuses on helping local nonprofits who want to use technology to increase economic mobility in Charlotte. One lucky nonprofit will be awarded $10,000 in cash and receive an additional $50,000 in free consulting.

After an initial survey and consulting session, Apparo’s pro bono consultants work with nonprofits to brainstorm how technology can solve their biggest challenges. They then assist the nonprofits in building a proposal for a tech-based solution that can maximize the organization’s work. The Ada Jenkins Center, a community center located in Davidson, was the 2019 Mission Possible Award winner. Nonprofits can visit https://www.apparo.org/nonprofits/mission-possible/ to complete the survey and learn more about the award process.

“As we continue to deal with the effects of the COVID-19 pandemic, being able to leverage technology has become more important to nonprofit organizations than ever before,” Lanphear explains. “The impact of this award can be seen throughout our community, in the ways previous winners are coming out stronger than ever through the crisis.”

Apparo is accepting nominations for the TechExec Community Impact Award until Tuesday, August 11. Eligible nonprofits interested in participating in the Mission Possible Award must complete a survey and schedule an initial consulting session by Friday, October 9.

Second North Carolina County Approves Reparations For Black Citizens

0

A second North Carolina county has just passed a new resolution to provide reparations for black residents.

Yesterday, Buncombe County officials passed RESOLUTION NO. 20-08-03, which focuses on county efforts to prioritize and eliminate racial equity, including education gaps as well as disparities in the health care and justice systems.

The county now joins Asheville in passing a similar reparations resolution.

Last month, the Asheville City Council voted unanimously 7-0 to pass the “RESOLUTION SUPPORTING COMMUNITY REPARATIONS FOR BLACK ASHEVILLE“, which apologizes for the city’s historic role in slavery and discrimination and orders the establishment of a process and commission for “repairing the damage caused by public and private systemic Racism”.

According to the National Coalition of Blacks for Reparations in America, ‘reparations’ are “a process of repairing, healing and restoring a people injured because of their group identity and in violation of their fundamental human rights by governments, corporations, institutions and families”.

In an interview with Ashville Today, Racial Justice Coalition of Ashville’s Community Liaison Rob Thomas (who led the push for the new resolution) noted;

“Black people are deeply impoverished and over policed here, and the lack of economic mobility can be traced back to this city’s negligence and intentional disposal of black wealth. It seems that the most responsible move at this point is to reallocate a lot of the $30 million dollars and directly re-invest it into black neighborhoods. We do not want programs, we aren’t looking for white saviorism; we want land, property, businesses. We want economic mobility and a way to produce generational wealth.”

What do you think about the new reparations measures?

Cannabis Oil for Dogs: Everything You Need to Know

0

Cannabis oil has become one of the latest things to sweep the world in the last decade or so. People have begun using it for all sorts of purposes, from treating specific conditions to helping to improve their general wellbeing.

However, one thing that many people are only now getting to grips with is using CBD oil for dogs and its several benefits for dogs. The idea of giving your favorite furry friend CBD oil likely seems pretty confusing for most people – after all, couldn’t it be dangerous?

Here is a brief guide on everything you need to know about giving cannabis oil to your dog.

Is CBD Oil for Dogs Safe?

The first question that every single pet owner should be asking is whether or not giving CBD oil to their pets is safe. While you can find in-depth information on sites like WayofLeaf, the brief answer is that yes, CBD oil is safe for dogs.

CBD oil works through its interactions with the endocannabinoid system, which is a system not only found in humans. It is actually found in all mammals, including your dog. This means that CBD oil works just as effectively for your dog as it does for you. There is thus no real risk when giving CBD oil to your four-legged friend.

In fact, CBD oil can be incredibly beneficial for your pooch, helping them to deal with all manner of different conditions.

So, what are these conditions? How could CBD oil help your dog?

What Kinds of Conditions Can CBD Oil Help to Treat in Your Dog?

Arthritis

While most people that don’t own dogs assume it is a literal walk in the park, caring for a dog will inevitably lead to some kind of health issue coming up. These health conditions include all kinds of things, with various complications to a dog’s living standard sometimes resulting in some difficult choices for the owner.

However, conditions like arthritis can be treated early with CBD oil. CBD oil is well-known for its effectiveness as an anti-inflammatory, making it incredibly easy to use as a treatment for arthritis. Various studies, such as this one by Hammell et al. for the European Journal of Pain, have confirmed that CBD oil can help treat arthritis thanks to its interaction with the CB2 receptors within the ECS.

Arthritis affects dogs, especially breeds like Labradors and Golden Retrievers, as they start to get older. So if your dog is struggling with getting out of bed in the morning, you might want to consider giving them CBD oil.

Pain

In the same way that arthritis affects all dogs if they reach an older age, pain is another thing that dogs have to suffer with. Whether stemming from arthritis or a different chronic condition, dogs suffering pain without recourse is a terrible thing, especially for the owners.

CBD oil is an effective pain reliever thanks to its interaction with the endocannabinoid system. It works with the CB1 receptor, diminishing pain and helping to relieve the pressure of having that constant pain.

This is especially significant for dogs because a dog cannot properly articulate that it is suffering pain, other than acting slightly dejected.

What Do You Need to Watch out for When Giving Your Dog CBD Oil?

CBD oil is completely safe for dogs and is incredibly beneficial as well, but that does not mean that there aren’t a few things you need to consider.

Dogs are mammals, exactly like us, but they have one key difference that makes dosage specifications a bit different – their weight. Dogs weigh a lot less than us, as well as having a higher rate of metabolism.

All this means that it takes a lot less CBD to have the same effect in their bodies as it does in ours. You want to make sure you don’t waste your CBD oil when you give it to them, as they only need a little bit.

You should also pay attention to the THC concentration of the CBD oil – if there is any. Many CBD oils, especially full-spectrum ones, will contain a very tiny amount of THC as an impurity. While it is harmless and legal for us to consume, there is a risk that your dog might not react well to it.

To be safe, make sure only to buy CBD isolate for your dog, so that every last drop of THC has been completely removed.

What Is CBD Isolate and What Is It Used for?

0

When shopping for CBD products, there are a few key terms that you are likely to come across, no matter which brands or types of CBD you choose. Two of these terms include full-spectrum CBD and CBD isolate, referring to CBD’s type within any given product.

Many people do not fully understand the precise differences between CBD Isolate and full-spectrum CBD, merely choosing the most appealing products. While both types of CBD are absolutely beautiful and will provide your body with a healthy dose of CBD, the two are actually very different. They will determine the effects that you experience.

So, what exactly is CBD isolate – and is it the right option for you?

What Is CBD Isolate?

CBD isolate refers to pure CBD that has undergone an intensive process to remove all other compounds. CBD is one of the many compounds found within both hemp and cannabis plants. Many brands opt to source their CBD from hemp plants as it provides much lower base levels of THC, making it easier to ensure products don’t have any unwanted psychoactive effects.

Both hemp and cannabis plants contain hundreds of different cannabinoids, terpenes, and flavonoids. In order to create CBD isolate, a number of intense filtration methods are used to remove all of the cannabinoids, other than CBD, along with all of the other compounds within the plant. The result is pure CBD.

CBD isolate is an excellent way to provide your body with pure CBD, giving you complete control over the cannabinoids that you put into your body and the effects felt. CBD isolate can also be used to create your own CBD items by combining your favorite terpenes with CBD slate powder.

How Does CBD Isolate Compare to Full-Spectrum CBD?

CBD isolate is just one of three different types of CBD. Full-spectrum CBD is the other most commonly found form of CBD, while broad-spectrum offers a mid-ground between the two.

Full-spectrum is considered the complete opposite of CBD isolate, with all of the naturally occurring cannabinoids, terpenes, and flavonoids found within hemp plants retained. Many people believe that full-spectrum CBD provides much more powerful effects as the different cannabinoids work together to trigger the entourage effect.

In sum, CBD isolate contains just the one cannabinoid, CBD, while full-spectrum CBD is packed with hundreds of different cannabinoids alongside CBD.

So, is CBD isolate better than the other options?

Pros and Cons of CBD Isolate

Pros:

  • With CBD isolate, you know exactly what you are putting into your body, giving you much more control.
  • CBD isolate can be used to create your own CBD products, giving you the ability to get creative and try out different terpene and CBD combinations.
  • CBD isolate’s effects are slightly more predictable as no other cannabinoids are reacting with your body.

Cons:

  • CBD on its own cannot trigger the entourage effect, meaning that it may not work to its full potential.
  • In order to create CBD isolate, more intensive filtration methods are required, and products can, therefore, be more expensive.
  • CBD isolate lacks the natural herbal flavor that is often found in full-spectrum CBD because all the terpenes from the plant have been removed.

Where to Find CBD Isolate Products

An increasing number of brands are offering CBD isolate products in order to provide their customers with as much choice as possible. An excellent brand for quality CBD isolate is Provacan.

Provacan is known for using straightforward, all-natural formulas to create its products, resulting in a pure CBD experience without any added chemicals and flavorings that are often found with other brands.

When shopping with Provacan, there are two different concentrations of CBD isolate to choose from; their 1000mg and much more powerful 5000mg CBD pots. Provacan uses third-party lab testing to check the photochemical content of their CBD isolate products to ensure that they are 100% pure and free from THC.

Provacan’s CBD isolates are the perfect solution for anyone who wants CBD’s power without having to worry about the other compounds that they are unknowingly putting into their body.

Final Thoughts on CBD Isolate

Whether CBD isolate is the best CBD option remains an ongoing debate among serious CBD users, industry experts, and casual consumers. Which choice is the right one for you will depend on what you hope to gain from consuming CBD and how you prefer to do so.

CBD isolate best for those who like to mix their terpene and CBD blends, creating their very own unique items. Equally, CBD can be a handy tool for those who require a super-concentrated CBD dose every day to manage specific health concerns.
