State and local governments across the country have wisely suspended regulations to help fight the coronavirus.
Below is a list of suspended rules and regulations from the state of North Carolina.
“North Carolina temporarily lifted a regulation requiring hospitals to get state permission to add beds. The rule said hospitals couldn’t add more than 10% of their licensed bed capacity without state approval… Applying for a CON can cost as much as $500,000, and the state board which grants CONs doesn’t meet for months.” – The Tribune Papers
“DPS, in conjunction with the North Carolina Department of Transportation (“DOT”), shall waive the maximum hours of service for drivers prescribed by DPS pursuant to N.C. Gen. Stat. 20-381. DPS, in conjunction with DOT, shall waive certain size and weight restrictions and penalties… for vehicles transporting equipment and supplies for the restoration of utility services, and vehicles carrying essentials and equipment for any debris removal in support of emergency relief efforts in the Emergency Area.” – Office of Governor Roy Cooper
“Section 1 delegates to the Secretary of Health & Human Services authority to waive or modify the enforcement of any legal or regulatory constraints that would prevent or impair: … (c) Temporarily adding dialysis stations, (d) Temporarily relocating dialysis stations, (e) Temporarily acquiring CT or MRI scanners, or (f) Allowing an ambulatory surgical facility to operate as a temporary hospital.” – Office of Governor Roy Cooper
“Section 2 authorizes child care facilities to remain open or reopen under new guidelines that adapt regulatory requirements to the circumstances of the COVID-19 pandemic. The Order delegates to the Secretary of Health and Human Services authority to waive or modify enforcement of certain regulations, including: Regulations on child care facility requirements, activities, records, orientation, continuing education, food, and attendance, including without limitation 10A N.C. Admin. Code 09 .0201, .0508, .0510, .0703(c) and (d), .0901, .1101(a), .1401(a) and (f), .1402(b), .1709, .1718, .1721(a)(1) and (a)(2), .2318(6), .2504, .2508, .2830, .3003, and .3005.” – Office of Governor Roy Cooper 
“Section 3 takes several actions meant to add additional health care workers to the North Carolina system. First, in Section 3(A), the Governor delegates to each professional health care licensure board the authority to waive or modify enforcement of any legal or regulatory constraints that would prevent: (i) Allowing practice in North Carolina by health care professionals that are licensed in other states, but not in North Carolina…” – Office of Governor Roy Cooper
“Section 3 takes several actions meant to add additional health care workers to the North Carolina system. First, in Section 3(A), the Governor delegates to each professional health care licensure board the authority to waive or modify enforcement of any legal or regulatory constraints that would prevent: (ii) Allowing retired or inactive health care professionals to provide care…” – Office of Governor Roy Cooper
“Section 3 takes several actions meant to add additional health care workers to the North Carolina system. First, in Section 3(A), the Governor delegates to each professional health care licensure board the authority to waive or modify enforcement of any legal or regulatory constraints that would prevent: … (iii) Allowing skilled, but unlicensed volunteers to provide care; and/or (iv) Allowing students to provide care if they are at an appropriately advanced stage of professional study.” – Office of Governor Roy Cooper 
“Section 5 suspends certain regulations that could prevent or impair providing mental health and substance use disorder treatment services and support services for individuals with intellectual and/or developmental disabilities (“MH/DD/SAS” services). “Section 6(B) allows the Secretary of Health and Human Services to waive or modify the enforcement of regulations on initial assessments or supervisory visits, adapting those provisions for social distancing during the COVID-19 pandemic. The Secretary of Health and Human Services is delegated authority to waive or modify enforcement of the following regulations: Regulations on initial assessment for agencies providing in-home aide services, including but not limited to 10A N.C. Admin. Code 13J .1107.; Regulations on supervisory visits for in-home caregivers, including but not limited to 10A N.C. Admin. Code 13J .1110.; Any regulations that are related to the provisions listed above.” – Office of Governor Roy Cooper 
“Because of the COVID-19 crisis, private health care providers are facing extreme difficulty in maintaining their workforce. Section 6(C) allows private health care providers, other than child care providers, to avoid a problem indirectly caused by certain counties failing to offer fingerprinting during the COVID-19 pandemic. Some counties currently fail to offer fingerprinting. Without fingerprinting, national background checks cannot be performed, although state background checks can still be performed. National background checks are required for certain new hires. Therefore, under Section 6(C), the Secretary of Health and Human Services is delegated the authority to give health care providers (other than child care providers) additional time to complete the national background check part of a new hire’s application.” – Office of Governor Roy Cooper
“The Secretary may, upon finding that a waiver or modification of enforcement will provide necessary relief to local health departments responding to the COVID-19 pandemic and will not endanger public health, (a) waive or modify enforcement of local health department mandated services requirements under 1 0A N.C. Admin. Code 46 .0200 and (b) may extend the time period for public health nurses to complete training sponsored by the North Carolina Department of Health and Human Services (“NCDHHS”) under l0A N.C. 2.0 Magnitude Earthquake Just Hit North Carolina, About 70 Miles North-West of Charlotte

The U.S. Geological Survey just reported an earthquake in Spruce Pine, NC, about 70 miles North West of Charlotte.

According to the USGS, the magnitude 2.0 quake had a depth of 2.6 km and an epicenter of 35.908°N 82.061°W.

Earthquakes have been increasing in frequency around the Charlotte region over the past few years. Last year, we saw a 4.4 magnitude quake hit Decatur, TN, and a couple months ago, a 2.6 magnitude quake rocked a small town just north of Charlotte.

The Carolinas have been known to experience the occasional damage-causing earthquakes.

According to USGS.gov, “The largest earthquake in the area (magnitude 5.1) occurred in 1916. Moderately damaging earthquakes strike the inland Carolinas every few decades, and smaller earthquakes are felt about once each year or two.”

The Instagram trend started to take off last Friday when a local couple uploaded a romantic picture in front of the field off Brattonsville Rd in York County;

Pros and Cons of the Home Loan Overdraft Facility

Prepayment of home loans has two critical benefits: firstly, it saves the interest outgo and secondly; it reduces the home loan tenure. However, most lenders levy fines and penalties on the borrowers for making prepayments. Not to forget, paying over the stipulated EMI amount can reduce the cash flow for emergencies.

One option to overcome these limitations is by opting for an overdraft facility. However, the question remains – is it better than the conventional home loan? 

Let’s analyze its pros and cons to find out more.

What Is an Overdraft Facility?

An overdraft facility is a loan agreement between the lender and the borrower, linked to a bank or savings account. The facility allows borrowers to withdraw or ‘overdraw’ sums that exceed the current balance in their linked account, and up to an approved credit limit.

Interest is to be paid only on the amount withdrawn and only for the time it is borrowed. Furthermore, the borrower has to provide collateral to avail the overdraft facility.

How Does It Work for Home loans?

Your home loan account with an overdraft facility is linked to a dedicated bank/savings account. Any amount deposited in home loan account – that is over and above the stipulated EMI amount – is treated as a prepayment for the housing loan principal amount, for as long as it remains there. 

During the tenure, borrowers can deposit as well as withdraw the surplus money in the account, anytime. Like conventional home loan plans, the surplus sum deposited in the account is deducted from the outstanding principal loan amount to calculate the interest payable. However, the interest is calculated daily and debited at the end of each month.

Likewise, when the borrower withdraws the surplus amount from the account (exceeding the account balance), the interest payable depends on the amount withdrawn and the period for which it was withdrawn.

Pros

  • Allows prepayment of home loans and consequently, brings down the overall loan liability by reducing the home loan interest rates and shortening the loan tenure.
  • Facility users can withdraw the surplus amount deposited in the home loan account during financial emergencies.
  • Unlike conventional home loans, there is no penalty for the prepayment of the home loan amount.
  • The surplus amount can be withdrawn or deposited at convenience, offering greater liquidity.

Cons 

  • In comparison to conventional easy home loan plans, lenders charge a slightly higher home loan interest rate in India for the overdraft facility. Thus, making it a more expensive option.
  • The surplus amount used to prepay the housing loan is not eligible for rebate under the Section 80C of the ITA. 
  • Lastly, managing the overdraft facility is difficult without a regular surplus income.

Experts suggest conducting a cost-benefit analysis to determine if the home loan interest saved on the prepayment is more than the cost of servicing a regular home loan – before settling for the overdraft facility.

Nonetheless, before buying a house remember to use a home loan EMI calculator and then apply for a home loan online or offline. This way, you will be able to check your home loan eligibility and to estimate the EMI amount, you can make a more informed choice.

Eastern Band of Cherokee Indians Files Amended Complaint Against Department of the Interior

The Eastern Band of Cherokee Indians (EBCI) has filed an amended complaint in its federal lawsuit against the unlawful decision of the U.S. Department of the Interior (DOI) to take historic Cherokee land in North Carolina into trust for the Catawba Indian Nation of South Carolina to build a casino.   The decision by the DOI will allow the South Carolina tribe to ump across state lines and build a casino near Kings Mountain, North Carolina, without the required consultation with the EBCI and without approval by North Carolina lawmakers or the people of North Carolina.  A combination of federal and state laws – which the Catawba Indian Nation agreed to in 1993 – prohibits the Catawba tribe from building and operating a casino in South Carolina.  Now it wants to jump state lines and open a casino in North Carolina.  The facts and the law demonstrate that the DOI’s decision to allow this is unlawful.

The plaintiffs in the lawsuit are the EBCI and twelve of its members who live near the Kings Mountain site. Additionally, the Cherokee Nation based in Tahlequah, Oklahoma, filed its own amended complaint, seeking to protect cultural artifacts on their ancestral land where the illegal casino is planned.

Commenting on the filing, Richard G. Sneed, Principal Chief of the EBCI, said “We welcome the growing coalition that is fighting against the DOI’s decision.  The decision is an egregious violation of federal law, and our amended complaint will establish for the court that there is no legitimate, legal basis for the decision.”

Among other things, the amended complaint reveals the following:

  • The driving force behind the DOI’s acquisition of land is unsavory but well-connected casino developer in South Carolina, Wallace Cheves, who has prevailed upon the Catawba Indian Nation of South Carolina to lend its name to the scheme and has deployed his influence to reverse the DOI’s long-held position that this type of land-into-trust acquisition is illegal.
  • In 2007, two Catawba-connected businessmen pleaded guilty to a scheme to unlawfully funnel Catawba Indian Nation funds to political candidates to reverse South Carolina’s ban on gaming by the Catawba. On the heels of those convictions, Wallace Cheves—who has a history of criminal and civil enforcement actions against him and his companies for illegal gambling—prevailed on the Catawba to try its luck in North Carolina.
  • The controlling statutes – enacted at the behest of the Catawba Indian Nation in 1993 – require that a specific process be used for acquiring trust land for the Catawba Indian Nation and that trust land has to be in South Carolina – and until Congress changes the law the DOI’s decision giving North Carolina land, particularly historic Cherokee land, is null and void.
  • The DOI clearly violated other legal requirements including early consultation with the EBCI to identify and protect Cherokee cultural resources located at the Kings Mountain site, and producing a “hard look” environmental impact statement, which was never conducted.
  • All told, the DOI unequivocally violated the law in their hastily rendered decision to take this land into trust for the Catawba casino project in Kings Mountain, North Carolina.

Principal Chief Sneed said, “Despite political contributions and questionable lobbying campaigns conducted by Mr. Cheves, the facts and the law are clearly on the side of the Eastern Band of Cherokee Indians and our fellow plaintiffs. We feel confident we will be vindicated by the court.”

Repticon 2020 is not without controversy, however, especially during the COVID-19 pandemic.

Today, the World Animal Protection sent a letter to Repticon asking them to call off the event. Ben Williamson, US programs director, commented; ‘It’s inconceivable that when many states are still seeing increases in the number of Covid-19 cases, Repticon in North Carolina would consider playing host to a live wild animal market. While Covid-19 is believed to have started many thousands of miles away in Wuhan, China, the conditions of live animals being confined together in close proximity to humans are remarkably similar to those we’ve investigated at US reptile markets such as Repticon.

25-year-old Sergio Ruiz is a midfielder and a captain for the international renown second division Spanish club, Racing de Santander.
